Complaints Panel
A complaints panel determines whether or not it is comfortably satisfied that a member has engaged in improper conduct,
If a complaints panel is satisfied the member is guilty of improper conduct, it may or may not decide to impose one or more of the following sanctions:
expulsion from membership;
suspension from membership;
a fine;
reprimand;
admonition;
the undertaking of specified professional development;
the obligation for specified decisions to be referred from time to time to an appropriate person;
the obligation to operate professionally for a specified time under the supervision of an appropriate person;
suspension of certification on the relevant national register administered by Engineers Australia until specified actions have been completed; and
withdrawal of certification on the relevant national register administered by Engineers Australia.
The standard of proof used in disciplinary hearings is that the complaints panel must be 'comfortably satisfied' on the evidence before it that the member has engaged in improper conduct.
