Engineers Australia Queensland President’s update Friday, 09 September 2016

Engineers Australia Queensland President Dr Peter Ho AM FIEAust CPEng RPEQ updates you on a recent Supreme Court case, Division Committee and College elections and the Queensland AEEAs.

Recent Supreme Court case

A recent Supreme Court case “Queensland Building and Construction Commission v Marshall & Ors [2016]” QSC 200 (15/12235), determined that QBCC may recover payment on a claim under the statutory insurance scheme from a certifier. This was despite the BQCC Act exempting work performed by a certifier from the definition of building work. The implication being that the person against whom a claim could arise is not limited to the building contractor who actually performed the work. By extension, engineers involved in domestic design and construction may also be liable should their services be found to be improper. The Division’s view is that any charge of improper performance of engineering services must be investigated by persons with the appropriate qualifications and experience in the subject matter.

Elections

Voting for the 2017 Division Committee members and various Colleges is open to eligible members until 5:00pm AEST Friday 30 September 2016. Now is the time for you to cast your vote to elect capable members to serve our professional body.

Those voted in the Queensland Division Committee may become Vice President or President in the future, representing Engineers Australia Queensland to be the local voice of our profession. I urge all eligible members to cast their vote, as we need high calibre individuals to collectively lead our organisation forward.
